I am a patent agent, licensed only by the U.S. Patent and Trademark Office (U.S.P.T.O.) to represent parties in patent cases before the U.S.P.T.O. and to give advice directly related to that function. My registration number with the U.S.P.T.O. is 50,535. You should be aware that I am not admitted to the general practice of law in any state. Therefore, while I can represent parties before the U.S.P.T.O. in patent cases, and I can offer opinions as to patentability and other legal matters that are directly related to the pursuit of a patent, I cannot opine on the validity of any U.S. patent, or on whether or not any particular U.S. patent is infringed. I also cannot draft or negotiate contracts or licenses that involve patents, because those are matters that are typically considered to involve the general practice of law (as I understand the law). Additionally, I cannot provide assistance with trademarks, copyright, or other areas of intellectual property law. Therefore, if your legal needs exceed my scope of practice or if (in my opinion) you would benefit from the advice of a patent attorney, I will be happy to refer you to a colleague who is fully licensed to provide the services you require. If you should choose not to take my advice to consult with an attorney, I will not be held liable for any consequences that result from that decision. Additionally, although I make a reasonable attempt to identify situations in which my clients might benefit from the advice of a patent attorney, I cannot guarantee that I will be able to identify and inform you of all situations in which such advice may be of benefit to you. Despite the limitations on the scope of my practice, patent agents are required by the U.S.P.T.O. to uphold a very strict code of ethics set forth in 37 C.F.R. Parts 10 and 11. Among other things, patent agents are required to keep the secrets of their clients confidential. Conduct not in accord with the code of ethics may cause me to lose my license.
